On the regulation of tariffs for registration, technical inventory, and cadastre services of real estate

In accordance with Decrees of the President of the Republic of Azerbaijan No. 1983 dated January 21, 2023 ‘On the implementation of Law of the Republic of Azerbaijan No. 646 VIQD dated November 29, 2022 “On Amendments to the Land Code of the Republic of Azerbaijan” and on making amendments to Decree of the President of the Republic of Azerbaijan No. 176 dated August 4, 1999 “On the Implementation of the Land Code of the Republic of Azerbaijan Approved by Law of the republic of Azerbaijan dated June 25, 1999’’’; No.1984 dated January 21, 2023 ‘On the Implementation of Law of the Republic of Azerbaijan No . 647-VIQD dated November 29, 2022 “On Amendments to the Law of the Republic of Azerbaijan ‘On the State Register of Real Estate’’’ and on making amendments to Decree of the President of the Republic of Azerbaijan No. 113 dated August 10, 2004 “On the Implementation of the Law of the Republic of Azerbaijan ‘On State Register of Real Estate’’’’; and No. 1985 dated January 21, 2023 ‘On the Implementation of Law of the Republic of Azerbaijan No. 648-VIQD dated November 29, 2022 “On Amendments to the Law of the Republic of Azerbaijan ‘On State Land Cadastre, Land Monitoring, and Land Management’’’ and on making amendments to Decree of the President of the Republic of Azerbaijan No. 113 dated March 12, 1999 “On the Implementation of the Law of the Republic of Azerbaijan ‘On State Cadastre and Land Monitoring, and Land Management’’’’, as well as pursuant to the “Regulations on the Tariff (Price) Council of Republic of Azerbaijan’ approved by Decree of the President of the Republic  of Azerbaijan No. 341 dated December 26, 2005, and the ‘Rules on Ensuring State Control Over the Formation and Application of State-Regulated Tariffs (Prices)’ approved by Resolution of the Cabinet of the Ministers of the Republic of Azerbaijan No. 247 dated December 30, 2005, the Tariff (Price) Council of the Republic of Azerbaijan RESOLVES:

1.    The Tariffs for registration, technical inventory, and cadastre services of real estate shall be approved (attached)

2.    Resolution No. 2 of the Tariff (Price) Council of the Republic of Azerbaijan dated January 4, 2021 “On the regulation of tariffs for services rendered by the entities of the State Service on Property Issues under the Ministry of Economy related to Cadastre, registration, and technical inventory of real estate and land plots” shall be prepared.

3.    This resolution shall enter into force on August 14, 2023.

2. Land plots

II. Land cadastre and land monitoring works carried out upon request

Note 1. In applications regarding the state registration of rights to real estate, where the legally established execution timeframes for the services provided under Section IV of the table are expedited at the request of the rightholder (provided that it does not delay the execution timeframes of previously received applications), a coefficient of 3.0 shall be applied to the approved service tariffs if executed within one business day; a coefficient of 2.0 shall be applied to the relevant service tariffs if executed within three business days; and a coefficient of 1.5 shall be applied to the relevant service tariffs if executed within seven business days.

However, where the execution timeframe for applications regarding the state registration of rights to real estate is extended due to technical inventory, measurement, and land demarcation works, if the legally established total execution timeframe of the applications is expedited at the request of the rightholder and executed within two business days, a coefficient of 3.0 shall be applied to the service tariffs approved under Sections I and IV of the table; a coefficient of 2.0 shall be applied to the relevant service tariffs if executed within five business days; and a coefficient of 1.5 shall be applied to the relevant tariffs if executed within ten business days.

In applications regarding the state registration of mortgages, where the legally established execution timeframes for the services provided under Section IV of the table are expedited at the request of the rightholder and executed within one business day, a coefficient of 3.0 shall be applied to the approved service tariffs; and a coefficient of 2.0 shall be applied to the relevant service tariffs if executed within two business days.

Note 2. In respect of real estate objects, a coefficient of 0.8 shall be applied to the service fee amounts calculated based on the tariffs established under Section I for Absheron district, and the cities of Ganja and Sumgayit; a coefficient of 0.7 shall be applied for other cities and districts; and a coefficient of 0.5 shall be applied to the calculated service fee amounts in respect of real estate objects located in the liberated territories.

Note 3. A coefficient of 0.5 shall be applied to the service fee amounts calculated for the real estate of persons recognized by law as members of martyr families, as well as military personnel and civilians disabled as a result of military operations.

Note 4. The coefficients shall be applied in the appropriate sequence to the tariffs established in the sections of this table, in accordance with the specific circumstances indicated in the applications for the cadastre and registration of real estate and land plots, and the final service fee for the provided service shall be calculated and determined.
