Since the commencement of the implementation of the Decree of the President of the Republic of Azerbaijan dated June 14, 2023, 'On Additional Measures Related to Issuing Operation Permits for Certain Non-Residential Construction Objects,' operation permits have been issued for 5,557 real estate properties to date. Ownership rights for 4,196 of these properties have been registered in the state registry, and extracts have been presented to the right holders by the State Service on Property Issues under the Ministry of Economy. The presentation of extracts for properties with operation permits is ongoing.
It should be noted that, according to the Decree, the process of receiving applications for issuing operation permits for non-residential objects whose construction and installation works were completed by June 1, 2023, and which were constructed without full compliance with certain requirements of urban planning and construction legislation, are currently ongoing through the regional centers of the Ministry of Emergency Situations. Property owners who applied to the aforementioned institution by January 1, 2026, will have the right to benefit from the simplified procedure.
Under this procedure, following the submission of initial documents, applications are registered through a special electronic portal. Upon the submission of the full set of required documents, the information is forwarded to the relevant government agencies for conducting the respective examinations. If there is a positive opinion from the relevant government agencies, an operation permit for the objects is issued. Based on this document, property owners may apply to the State Service on Property Issues for obtaining an extract.
The legalization of properties creates vital advantages for entrepreneurs, such as the full formalization of ownership rights, expansion of access to financial resources through the pledging of assets, as well as ensuring compliance with safety and operation standards. The total market value of the 4,196 non-residential properties formalized as a result of the Decree's implementation amounts to approximately 4 billion AZN, which constitutes a significant contribution to the country's economy in terms of additional capitalization and the formalization of business activities.
In addition, under the aforementioned Decree, the Cabinet of Ministers of the Republic of Azerbaijan has been tasked with organizing measures provided for by legislation by June 1, 2026, to resolve problems arising from the construction of non-residential buildings without operation permits in violation of the requirements of land and construction legislation.
